Jure Matrimonii
Jure Matrimonii is the process of acquiring Italian citizenship through marriage or civil union/same-sex marriage with an Italian citizen.
If you are the spouse of an Italian Citizen and have been married for a minimum of 3 years, you are eligible to request Italian Citizenship through Jure Matrimonii.
If you are the spouse of an Italian Citizen and have resided in Italy for at least 2 years, you are eligible to request Italian Citizenship through Jure Matrimonii.
If you married an Italian man before April 26th, 1983, you automatically obtained Italian Citizenship - and thus, are able to claim Jure Matrimonii citizenship.
Outside Italy
After having been married to an Italian spouse for at least 3 years, a non-Italian spouse may request Italian Citizenship through Jure Matrimonii, provided that other conditions are met:
- The marriage must be registered with the (recognized) Italian Spouse's comune (municipality).
- The applicant must be able to provide criminal record checks/background certificates issued by every authority where the applicant has resided.
- The applicant has an equivalent fluency level in the Italian language of a minimum B1 level (as per the Common European Framework of Reference for Languages), and this ability is demonstrated through certification issued by an authorized language institute.
In Italy
- The marriage must be registered with the couple's comune (municipality) of residence.
- The applicant must be able to provide criminal record checks/background certificates issued by every authority where the applicant has resided.
- The applicant has an equivalent fluency level in the Italian language of a minimum B1 level (as per the Common European Framework of Reference for Languages), and this ability is demonstrated through certification issued by an authorized language institute.
Special Application
A woman who married an Italian man before April 26th, 1983 was automatically granted Italian Citizenship upon marriage to an Italian spouse.
Thus, Jure Matrimonii candidates who wish to become officially recognized Italian Citizens must follow a different procedure than those who married an Italian spouse after this date.
